More about the False Claims Act
The False Claims Act is a federal statute that allows whistleblowers to bring claims on behalf of the United States government.
In short, the Act’s purpose is to prevent the United States from being defrauded: It paid some company or university money. But had the U.S. known that the company or university was engaged in certain illegal misconducts, then the government would not have paid the money.
The False Claims Act allows the government to get its money back and assess the violator financial penalties. Moreover, it rewards the whistleblower for exposing the misconduct by giving the whistleblower a cut of the recovery and penalties.
The American Alliance for Equal Rights can bring claims under the False Claims Act. If the whistleblower is a member of AAER, then AAER can help him sue and get his recovery. AAER’s involvement means that the whistleblower’s identity can be shielded from disclosure to the public. AAER is particularly interested in allegations that corporations or universities were considering race or ethnicity as a factor in employment decisions such as hiring, promotion, pay, and the like.
AAER welcomes any and all information about possible violations of federal civil-rights laws, and it will keep all information submitted to it strictly confidential.
Potential whistleblowers should ask themselves the following questions:
- Do I have information about possible violations of federal civil-rights law, including, for example, illegal “DEI”?
- Is that information, at least in part, nonpublic? (For example, is it contained in presentations or emails that are internal to the organization?)
- Is the alleged violator a recipient of federal money? This can be a federal contractor, or a recipient of federal financial assistance (essentially all colleges and universities count).
